Terms of Service

The operating principles governing our collaboration, deliverables, and the shared responsibility of building exceptional digital products.

1. Acceptance of Terms

By accessing and using pixnexo.company, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. This document constitutes a legally binding agreement between you ("the Client") and PixNexo, a web design studio registered in Istanbul, Turkey.

These terms apply to all services offered, including but not limited to web design, development, UI/UX consultation, and post-launch maintenance. Engaging our services requires explicit agreement to these conditions, which supersede any prior oral or written agreements.

2. Scope, Deliverables, and Mutual Obligations

Clear boundaries create exceptional work. The following matrix defines the shared responsibilities required to deliver on time and on spec.

PixNexo Commitments

  • Design Execution: Deliver high-fidelity mockups, interactive prototypes, and responsive layouts aligned with project brief.
  • Technical Build: Develop valid, semantic code. Ensure cross-browser compatibility and performance optimization.
  • Communication: Provide weekly progress reports. Flag risks immediately. Maintain professional standards.
  • Launch Support: Verify deployment and provide 14-day bug-fixing window post-launch.

Client Responsibilities

  • Content Provision: Supply final text, images, and brand assets in agreed formats. Delays impact timeline.
  • Feedback Loops: Review deliverables within 3 business days. Consolidated feedback prevents scope creep.
  • Access & Credentials: Provide necessary server access, API keys, and administrative rights for integration.
  • Payment Terms: Adhere to the 50% upfront / 50% on delivery schedule to maintain active project status.

Method Note: Risk Mitigation

We structure obligations around input gates. Progression to the next milestone is strictly gated by the completion of required inputs (assets, approvals, payments). This eliminates ambiguity and protects both parties from indefinite revision loops.

Payment & Invoicing

Invoices are issued in EUR (€) unless otherwise agreed. A 50% deposit secures the start date. The final 50% is due upon project completion, prior to file handover or live deployment. Late payments incur a 1.5% monthly interest fee.

Intellectual Property

Upon final payment, PixNexo grants the Client exclusive ownership of all final design assets and custom code. PixNexo retains rights to showcase the work in its portfolio unless a strict NDA is in place.

Liability Limit

PixNexo is not liable for indirect damages, lost profits, or business interruption. Our total financial liability is limited to the total fee paid by the Client for the specific project.

We do not warrant that the software will be error-free or uninterrupted. Third-party integrations (APIs, plugins) are subject to their respective providers' terms.

Termination & Changes

For Cause: Either party may terminate with immediate effect if the other breaches material obligations and fails to cure within 10 days.

For Convenience: The Client may terminate at any time. Work completed up to termination is billable at our hourly rate (€120/hr). Unused deposits are non-refundable.

Scope Changes: Requests outside the agreed scope will be quoted separately and added to the project timeline.

These terms represent the complete agreement. If any clause is deemed unenforceable, the remaining terms remain valid.
